Driving While Under the Influence of Alcohol – Arrested

While on patrol, officers observed the vehicle drifting between two lanes on an empty street and then suspiciously matching the driving speeds of the police cruiser. At one point, the officers slowed down to approximately 5 mph on the empty street and observed the suspect doing the same before passing them, still at a very slow speed. Officer conducted a traffic stop and determined the driver was intoxicated. The driver, however, refused to allow them to conduct a field sobriety test but agreed to have a blood test. When the officers attempted to conduct the blood test, the driver again refused to cooperate. A search warrant was obtained, the driver’s blood was taken and the driver was arrested.
